Ford Motor Credit files breach of contract lawsuit

On Behalf of | Jan 10, 2019 | Commercial Litigation

Companies in Louisiana and elsewhere that enter an agreement to provide products and services to another business generally expect to be paid in full for services rendered. Should the other party fail to uphold its end of the arrangement, a company may wish to seek recovery of its financial losses through legal means. Ford Motor Credit has reportedly accused a dealership of breach of contract after alleging the auto group owes the company more than $116 million.

The lawsuit reportedly stems from information uncovered during an audit of a dealership chain. Ford claims the audit indicated the auto group had failed to pay the company for vehicles which had already been sold. Ford has accused a variety of dealerships of similar acts, and the process has reportedly caused several chains to pursue relief through bankruptcy.

Although the dealerships that have filed for bankruptcy have been removed from the lawsuit, one auto group remains accused of breach of contract. Ford claims this group is culpable of attempting to obtain double the amount in wholesale financing for each vehicle through fraudulent methods. The company is seeking restitution through a breach of contract lawsuit.

With a great deal on the line, business owners who encounter disputes such as a breach of contract may wish to take the necessary measures to protect their interests. When facing similar concerns, a person in Louisiana could find it helpful to consult with an experienced attorney early on for guidance on how best to approach the situation. An attorney can examine the client’s circumstances thoroughly and assist in pursuing restitution through a claim against the party or parties deemed responsible.
